TUPE (Urgent)

Dear Member,

I’m currently in the UK under Tier 2 work permit, the company I employee with is in the process of demerging, my employment will be covered under TUPE and one of the partner in the firm has already applied for the licence.

I have two questions in my mind;

First, do I allow working with the new company while we wait for the sponsor licence?

Secondly, when does my current leave to remain will be curtailed is it either when the old company ceases to trading or the application for new sponsor licence is unsuccessful?

Any help much appreciate.

it gets curtailed when your employer notifies ukba and then ukba writes to you telling you that your visa is curtailed

Can you be able to answer my first question, also which employer has a liability to report to UKBA about the curtailment the old or the new sponsor.
