Stupid Question if one exists

Hi Guys.

I left the USA in Feb 2008 after discovering I had overstayed my time in the US. Since then I have filed and been rejected to return on a fiancee visa.

As a result I have since been appealing and looking into the waiver of ineligability. for best part of 15 months I have eagerly watched along with my fiancee the updates of our status.

Well last week the status showed as COMPLETED so we now believe a decision has been made however my fiance has been told by INS that they have requested that I have my criminal background check and medical done again.

Herein lies the potentially stupid question.

Would the INS request that I have my medical and criminal background check redone if there decision was going to be a negative one? Or as my fiancee believes does this mean that my appeal has been succesful pending a satisfactory result from the criminal background and medical check??

Any input would be appreciated.

1. How long did you overstay?

2. On what grounds was your K1 application denied?

3. What did you apply for, after your K1 application was denied?

Awesome news received today is that my waiver has been approved. just need to get a clean medical and criminal background check and its Viva Noo Joisey

Overstay

If you overstay your visa for more than 180 days you will face removal proceedings to be deported from the United States. Additionally, if you overstay for more than 180 days but less than one year then you will be inadmissible to the US for three years beyond that time and if you overstay for one year or greater you will be inadmissible for ten years. If you overstay but not more than 180 days you must leave the US but you can apply for a visa to return immediately.
