Eligibility for my ILR

Post by joshi008 » Tue May 17, 2011 4:43 pm

Hello All,

I have a query regarding my ILR. I am currently on Tier1 Visa and my wifes PR is due in March next year, she is also on Tier1 visa. My ILR is due after 2 years in June 2013 as I arrived in UK in June 2008.
My query is when my wife applies for her PR/ILR in next year March, will I be eligible to get PR along with my wife?

Following is our information in detail:

Wifes arrival in UK: March 2007
My arrival in UK: June 2008

MARRIAGE DATE: June 2009

Do let me know for the above query. Thanks in advance.

Best regards,
Gaurav.

Hello sushdmehta,
From June 2009 we have been staying together as we got married in June 2009. Does this period matter/count or is there any minimum number of period we need to be living together? Do let me know, thanks.

Best regards,
Gaurav.

If you change to dependant (from outside the UK) and can provide evidence of cohabitation in the UK for a period of at least 2 years, then you should be able to apply for settlement at the time as your wife (319E).

KOL required.

Refer to FLR(M) or SET(M) for acceptable documentary evidence to prove cohabitation.
