Applying for a Schengen Visa when your a Residence Spouse

Good afternoon,

Sorry if this has been covered before - i think this site is amazing and has helped me so much over the last year.

My partner is on a spouse visa (he has a biometric resident card - valid for 2 years)

We are going to spain in July and have appointment booked for a schengen visa next week. I spoke to VFS and they told me he couldnt apply as his card (visa) is not stamped in his passport. I then rang UKBA (croydon) and asked them how i go about transfering it over - and they informed me that the biometric cards for spouses are the only thing issued and has been for the last 6 months. No spouse residence visas are in passports any more.

What should we do? we are being told two different things?

I have just found this on the spainish Consulate site..

Please note that you may only apply for a visa if you are resident in the United Kingdom and your residence permit is stamped in your passport or in separated card. Your individual circumstances in the UK will denote the documents that you must produce when you come to lodge your application. Please see the particular point below which is applicable to you.

Passport valid with two full blank pages to affix the visa.
Two completed and signed visa application forms.
Two passport colour photographs.
Original and photocopy of EU passport or National ID card of the EU National or Spanish National.
UK residence permit

if anyone can help - would be most grateful..

We are actaully going to Lanzarote which is covered by Spainish visa right?

Which embassy was VFS working for when they talked to you?

I am British, born in the UK.

I rang the number on the VFS Spanish website and got transferred that way.

I would personally ignore what VFS have to say. The call centre is likely less well informed than people there.

Should should have a right to not use VFS and avoid their fees. See http://eumovement.wordpress.com/other-schengen/

But the Spanish embassy in London is repeatedly cited for being rude, not following the law, and worse.

On the other hand, going to Germany is lovely and it is easy for you to get a visa from them by post...

Could I apply straigt to the spainish embassy?

If you read the link I sent, they either must provide you with free service through VFS or allow you to lodge the application directly with the embassy.
