I'm writing this on behalf of a friend who is scheduled to visit the US from Australia next week. A year ago, he overstayed his B-1/B-2 visa (visitor/nonworking) by 2 days and several hours. Next week, he is planning to come to the US and apply for a Visa Waiver. I am concerned that he will be refused once he enters the US. On the one hand, it was only 2 days, it was a year ago, and he is Australian. Making him get back on a plane seems like a very steep penalty for this. On the other hand, I am afraid that overstaying a visa by any amount of time can put you on a ban list. Can anyone predict what will happen? Should he fly out here next week? Thank you!
