Dual British/SA Citizenship and the South African courts

Post by exxie » Sat May 21, 2011 12:55 am

Hi,

I have SA citizenship and gained British citizenship through naturalization. I am now fully settled in the UK.

Here is my concern:
Someone in SA is threatening to go to court to raise a case of slander. However, I am not guilty and I'm concerned that the SA court would want to summon me to testify. I believe that the court might also want to summon :

A 2nd person, a SA citizen that is currently living in the UK, plus
A 3rd person, a SA citizen that lives permanently in SA.

What are my options? Would I be obliged to fly all the way to SA to testify?

In most jurisdictions, including, I guess, South Africa, slander is a matter for the civil courts. So if someone accuses you of slander, it's up to you whether or not you want to turn up in court to defend the case.
But whether it's a civil or criminal matter, what your enquiry has to do with an immigration advice forum beats me.
