change of visa status

Post by mesrop899 » Sun May 22, 2011 8:01 pm

I am an student, studying an MBA in the UK under a Student Visa. Right now I am eligible to work part-time.

I met someone here, and we are engaged. I am eligible to apply for a PSW visa, however we wanted to settle down sooner and I need to change my visa status so I can work full-time without yet proceeding with our marriage. Is this possible if I applied to stay in the UK as an unmarried partner of a British Citizen via the FLR(M).

Am I eligible to apply for the FLR(M) and will it help me obtain permission to work full-time?

Are the two of you living together? If yes, have the two of you lived together for at least two years? If yes, can you prove it? If still yes, then yes you can use form FLR(M) to apply for an Unmarried Partner visa.

Otherwise, no.

If we married earlier, but we have not been together for 2 years, (we met about a year ago) would we still be able to apply for the FLR(M) straight away as married partners? And does the FLR (M) permit full-time work?

As soon as the marriage has happened you can use form FLR(M) to apply for a 2-year spouse visa. As soon as you have that visa, you will be permitted to work an unlimited number of hours, and you do not have to study, although you can continue to do that if you choose to do so.

But a word of warning, getting married just to ease a visa situation is very ill-advised. But if the two of you want to get married, and plan to spend the rest of your lives together, fine go ahead, but then of course not just to ease a visa situation.
