Maternity Leave outside UK during Tier 1 & effect on ILR

Post by nimitmori » Thu May 26, 2011 4:14 pm

Hello Everyone,
I am main applicant on 3+2 Tier 1 and currently in second phase of Tier 1 General visa. I am pregnant by 2 months and would like to have my baby delivered in India. I am getting paid leave for 6 months and my employer have no problem with that if I spend the same in India. I will be still left with 1 year & 6 months of Tier 1 when my baby is with me. I have got questions bothering me as mentioned below:

1) Will it affect my ILR application on completion of my 5 years Tier1 tenure?
2) Will my leave outside UK create any problem in '5 years compulsory stay' ?
3) Will my baby have any problem in getting Tier 1 in line with my own ?
I will be highly obliged if someone can help me with this !!

Thank you million times!!
nimit.

1. Yes, it can.
2. Yes, single absence of more than 90 days may reset the "5 years continuous stay" clock - depending on the reason(s) of such absence.
3. No.
