Can I apply for Tier 1 (PSW)?

Hi,

I have same concern of overstaying in the UK. Basically my student visa expiry date was 31st May 2010. I applied for EEA residence card thorough my wife in MARCH 2010 and I got the reply back from HO on 2nd October 2010 with refusal. With this reply they also sent me letter that they have lost my passport including all other documents. So I made my new passport straight away and left UK on 4th October 2010. I recieved my previous passport and documents behind me in first week of November 2010 which my wife recieved.

My degree was awarded on 16th Septmber 2010 and I had my EEA residence card application in process during that time and even after that when i recieved letter from HO where I was not even returned my passport so I made new passport from Embassy and left the country..

Can I apply for Tier 1 post study permit? my wife and daughter are still in the UK. I can apply visa through EEA route but I want my application to be quick and from Pakistan Tier 1 Posty study visa is quicker than EEA Family permit visa. Should I mentioned residency of my family in the UK who is EU national?..looking forward for goood advice..thanks..
