Re. ILR with combination of WP & ICT

Hi,
I have a query on ILR.

1. I came to UK on Workpermit in Feb'2007 and left UK in Nov'2008. My payroll is run till Dec'2008 and also my WP visa is expired in Dec'2008.

2. I came back to UK on ICT in Mar'2009 and continuing now.

Question there is no visa between Jan'09 till Feb'09. If I lawfully spend till Feb'2012, will I be eligible for ILR.
