HSMP Tier1 holder applying H1B (petition approved) from UK

Hi,

Complicated problem.. Please help.

Me and my husband are educated in India and HSMP tier1 approved in 2008 Nov valid till Nov 2011. Husband is primary and am depedent

- Due to reasons like recession and others We came to UK in Jan 2011 (Husband's employer gave job here),
He has work related contract till October 2011 with present employer, (Visa expires in Nov 2011)
- When in India, we applied for US H1b (employer petition approved April 2011)

My questions are
- Will our HSMP get extended?
Our earnings are both India and UK based. Husband gets Indian Salary and a allowance for working in UK. It is around 3000 per month roughly.
- Can we go for H1B, H4 stamping in UK?
My husband's US employer is based in Newyork.
- And I am pregnant :) due date is Jan 2012
work contract expires oct2011, visa expires nov 2011, and if extension not possible, I cant travel in 9th month... so we are planning delivery in India.
Husband's employer is willing to make work permit offer but we are not interested to take.
--- So, if HSMP Tier1 visa is extendable, we will stay here some time till April 2011 and if not I will move to India.

SO, Gurus please tell me if a person living in UK from Jan 2011 till Sep2011 can get HSMP tier1 extended legally?
As per the earnings calculator, we got a NO :)

It is called Tier 1 (General).

Read the policy guidance to understand the eligibility criteria for extension, and ascertain if your husband will be able to qualify for extension with 8-9 months of earnings.
