how to get leagel after marriage in the uk

hi guys
i've been in this country since 1998 on a one month visa but my visa has been expired since thn.i've no criminal record or anythings like that.
and now i'm leagly married to my wife(in the uk nand who is british citizen) since march 2011 and also we had our religous marriage in june 2010.and we have a beautiful daughter who is 4 weeks old.
what shall we do,shall we apply from here(uk) or shall i go back to my birth land????
to be honest with u guys we would like to apply from here beacause i really really don't want to stay away from my wife and my little princess.
any help will b so GREATFUL.thanks

You have no legal status in the UK and you need to go back to your country to apply fo a spousal visa

The OP may qualify for settlement next year (2012) under the 14 year long residence category.

thank you very much to u all.
kitty,i'm from india.
that was our 1st plan that i go back to india and apply from there but the problem is my mrs has to be working to suppot me(we been told that she needs last 3-6 months pay slips before we apply,it doesnt matter from here or from india)
my mrs have her parents here but her dad has been really ill for the last 4-5 months,so my mother in law busy looking after her husband.we have noone to look after our little daughter when my mrs start going back to work again.(you may say we can put our daughter into nursery but our daughter is way too young to be away from her parents and also we dont wanna do that until she's at least a year old)
what shall we do next????
