ILR query for work permit holder

Post by kk76 » Sun Jun 05, 2011 8:29 pm

Dear all

I am living in UK for more than 4 years. I will be made redundant in my work soon. So far I have spend 4 years and 3 months on work permit inside England.

Is it possible to apply for ILR now?
If No means, How long can i stay in UK to find another job after redundancy( my work permit is valid till March 2012- can i stay till that date)

Please send your reply for this post.

Thanks in advance.

Regards
Raj

if you read back of your work permit.. you find it is stated that you allowed to stay 28 days after you leave your work ...
it is not possible to submit for ILR now ... but you might think to find another employer who can sponsor you under tier 2...

I hope more senior people here can give you more informations ...

This has now changed and the new retroactive rule is now 60 days.

OP: Is there anyway you can hold out at your job until you are 4 years 6 months into your work permit? With the new recent rules, if you have less that 6 months left on your visa, then I do believe you will automatically get the rest of your visa validity (March 2012) to stay in the UK (and presumably find a new sponsor).

Thanks for your suggestions. Unfortunately I can't extend for 4 years and 6 months. I did go for couple of interviews and got the offer but they were not happy to apply for tier 2.

Do you have a link to the new retroactive rule? I thought this new policy only applied to those on Tier 2.

You can stay until your visa is curtailed or your leave expires, whichever is sooner.

It is a requirement for ILR that the person has been in work permit employment for 5 years, and is still required for the post. Not possible if the person gets made redundant 4.5 years in and fails to secure a new sponsor.
