Can i get access to the child Visa?

Hi,

I got married in March 2009, but could apply for spouse visa because my wife was not 21 years old. In 2010 just before expiring of my psw i applied for spouse visa, Home office granted me discretionary leave to remain for three years. Now me and my wife having difficult time and it looks like we wont be together in few months. We have a 3 years old daughter together.My question is would i be eligible for access to the child Visa without leaving UK?

no you would have to apply for entry clearance for the access to child visa. if you wanted to remain in the UK rather than apply for entry clearance then you could just apply for further DL instead.
