how early/late can I apply for extension

How soon or late can I apply for my Tier1 extension? My T1 runs out on 9th June 2011. I am planning a vacation from 7th May to 24th May.

Shall I apply in April waiting in anxiety for my passport to return? Or shall I apply after my vacations? I hope I don't have to apply 5 weeks earlier as a rule?

definately after your vacation, u will not get passport back in time, dont even think about it, go on holiday enjoy it and apply afterwards. applying before will bring you lots of hardship

Read the guidance as stated by HO.

When to applyWe encourage you to make your application at least 1 month before your current permission to stay expires. However, if you apply significantly more than 1 month before your permission to stay expires, and you want to apply for settlement later, you may not have accumulated enough total permission to stay. This is because your new permission to stay will begin on the date when we make the decision, not the date when your current permission expires.

I did read the guidance notes and hence the question. My T1 runs out on 9th June 2011. I am planning a vacation from 7th May to 24th May. Do you think its ok to apply after 24th May? I guess I would be OK in terms of legality right?

Yes, i think you should apply later in your case. There is literally no problem in that.

Let us take an example with the dates. You came to UK on 24th May after your holidays. You take 1 week to gather your all documents and fill your application form, and you apply on 31st May or 1st of June through special delivery. It will reach the HO the next day, and your application will be at their end latest by 2nd or 3rd of June.

According to HO, your application should reach before your visa expires. And it all seems good. Hope it helps.

hi hussain,

Was there any problem while applying ?
I am in trouble where we lost spouse passport and applying for new one on Monday.
We will be applying for visa on Tuesday or Wednsesday once we get the confirmation from emabssy that we have given passport application. (requested by immigration solicitor)

Our visa expires on 9th July 2011.

Hi,

My visa was running out on 9th June and I extended in person on 26th May, and I was also granted a 2 yr visa that same day. I had no problems.
