Tier 1- General Refused on payslips .

Hi
I need some help. I apply for my Tier1 - general VISA in march and I gave my Biometric on 16 April. On 07 June 2011 I got my Refusal letter from UKBA. They refuse my visa because my company pay slip was on plane paper and it was not sign and stamp by company.UKBA accepted my other income from other companies and from self -employment. I apply through a visa consultant who was my representative in Home office. He did not told me anything about that you should submit sign and stamp pay slips. UKBA wrote in refusal letter that they tried to contact my representative through email 12 may but there was no reply regarding your payslip evidence. So they reject it. My representative gave me a letter in which he is confirming me that he did not receive any email from UKBA. My Visa is expiring in 20 Jan 2012 . so I have no right to administrative review and appeal. I want to mention one thing more that I also submitted my P45 which I got from that company.which is a record of your pay and the tax that's been deducted from it so far in the tax year. Is P45 can be used as a proof of earning in tax year. What is the best I can do in this situation. Please give me some advice.

Unfortunately there is nothing you can now. Guidance is clear.

I'd blame your consultant who didn't check whether payslips were fit for purpose.

Does p45 cover all the earnings you claimed? If that was the case, why did you send your payslips as two different sources of earnings are sufficient.

yes p45 cover all my earning from that company in that tax year.

If the net salary stated in the P45 can be corraborated with your bank statements i.e if you sum up all the net salaries from that company from your bank statements and the total come up exactly the same as stated on your P45 then yes, points should have been awarded

Rizwan are you sure about all this. P45 and my bank statement total earnign is same.

you would get P45 from employer when u leave the job and it is not standard proof of your earning but if you have P60 then it is standard proof and you can also confirm from tier 1 guidance.

Hire a good legal expert and go for Judicial review and raise below points:

That you were never contacted by UKBA
P45 should have been considered automatically as a valid evidence in the absence of payslips.

Technically P45 have a same standing as P60. You get P60 at the end of year from your employer and you get P45 at the the time when you leave the employer.

Does your payslip contains any header/footer? Was it in color or black & white?
