switch from tier 4 to tier 2

dear users,

am currently on tier 4 and just received COS from my employer for tier2 ,but am a bit confuse and reluctant to apply, because firstly
my Job title: senior care worker
salary : 20k
Secondly my employer has done only 1 resident labour market test.

i would like to know what my chances are? and will my application be considered.because senior care worker is classified as borderline occupation plus what are the effect of switching from one category to another if my application went wrong.

any info regarding this matter. thanks.

all new tier 2 applications must be based on graduate-level job.

however, i vaguely recall there were talks of making an exception for senior case worker in some respect so you might need to further research!

acccording to the shortage occupation list, senior care workers appear on the list for Tier 2 applicants until 5 April 2011.

In addition - you say you are on tier 4 at the moment - have you completed your course for which your obtained your tier 4 visa? if so was it at least 12 months long?

i am on tier-4, valid till 2013. my employer has just conducted the resident labour market test and has yet to apply for cos. provided that he gets the cos, will i be able to apply for tier 2 in country?
i havent completed the course for which i was granted leave. but after one year that is in november i will complete 1 year diploma (though visa is granted for master level course). now the questions:
1: if employer gets cos in july, it will be valid for 3 months and i complete my diploma in novemer so can i then apply in country?
2:will the proposed tier 2 changes affect applications made inside the country
(that is temporary and permanent visa)?
3: is there any other way to get tier 2 as the employer is willing to sponsor. ut now the problem is that i am on tier 4 now. can some one advice any route to switch to tier 2 .
