Tier 1 (General) --Refused because my employer paid me cash

Post by krish007 » Sun Jun 12, 2011 6:48 pm

Hello Every one,

Recently i have applied for my Tier 1 General, and i was refused my visa.

the reason is --- actually for one month i was paid in cash by my employer and i have not deposited that money into the bank account as i have some personal payments to make.

I have already submitted a letter from my employer stated that they have paid mein cash for that month, and i have also submitted my P60.

but they have not accepted it, so does any one thing is there a chance for me if i appeal against there decision.

Thanks
Krishna

Have they given you right to appeal? If not, then unfortunately there is nothing you can do.

Two different sources of earnings must be provided to claim earnings. Both P60 and letter form employer fall under same source. This must be corrobroated normally by bank statements. As you were paid in cash and didn't deposit, you basically blew your chance.

Hello,

Thanks for the replay.

Yes they have given me a chance for appeal, i got 10 days to decide about it.

ya it was my mistake that i have not deposited that money into my account, as i have some urgent payments to make.

So is there any other chance that i can fight on this.

Thanks
Krishna

Even you have appeal, you may not submit new evidence.

If the 12 month period of income assessment was not April-March, then P60 is not a valid documentary evidence of previous income.

Actually i have started working with the new company from last August.

for my earning points i have used my salary from the month of august - march of this year.

so in my P60 from my new employer, it reflects the amount which i have used to claim my points.

Although you are technically weak but You still have some chance in appeal.

I have seen people getting decsion in their favour in appeal even though they have weak cases. So dont be dishearted and go for appeal. If you get a good judge then it wont be a big surprise if your appeal is approved. Because your reason is very logical.

Thanks Rizwan,

i have decided to go for Appeal, today morning i have called HRMC and have asked for my Tax Certificate for this last year, they seem to take 7 days to send to me, so i hope i can represent that in the court to defend my self, i still have a small doubt will that be considered as a new evidence, as they have stopped accepting any new evidence.
any any one as any idea how much it cost for appeal

Thanks
Krishna

Hello Every one,

Today i have received a letter from HMRC, stating my employment History for the last one year, in which it clearly states the amount which i have received from my employers, which i have used to claim points for my earning, but my concern is will this be a new evidence, as i have already send my P60 to them.

Thanks
