can somebody please help with exstending my partners stay

Post by launchit0 » Wed Jun 15, 2011 11:28 am

My partner is a Thai national and is coming to the end of a 6 month visa in the uk, we have a 18 month old baby that was born in Thailand but has dual nationality. We wish to extend the visa until Christmas time at which point i will be able to travel back to Thailand with them. My only problem is the cost of the application (£800) and the fact that i have been told that my application will probably be denied. I have been told that i could ask for an extension on medical grounds but to be honest i really don’t want to go down this route. My partner is living with us at the family home and we receive no benefits what so ever, i work full time and have a return plane ticket for us all. Could somebody please help me with what options i have available for extending their stay?

There are almost no grounds on which your partner can stay longer than the 6 months to which her visit visa entitled her. Nothing in your original statement gives any indication that anything is any different from when she originally applied for the visa. If the ECO who considered her application had thought that she would seek to stay longer in the UK she would have been refused.
Don't waste your time and money applying for an extension which would probably be refused, and maybe affect the outcome of future applications. She should return to Thailand to await you there.

Since you have a child which is a British citzen you could apply for her to stay in the UK under article 8 of the Human Rights Act - the right to a family life
