going on honeymoon with less than 2 months on visa

Post by hussainfarhad » Sun Jun 26, 2011 2:17 pm

Hi
just wanted to ask whether its a good idea to go on my honeymoon before submitting my FLR-m.basically i was plannin to go in 2nd week of sept but my visa finishes in mid november. i will be applying as a spouse of a british national so she will also be with me when i come back. is this gonna be a problem when comin back to the UK to apply or is it better to apply before leaving? problem is ive been goin into my Overdraft so my bank statements dont look that pretty.ive got a big enough OD but i dont know whether thats a prob too.

After marriage, your fiancé(e) visa is no longer valid. You may be refused entry due to change of circumstances and purpose. Better switch to FLR(M) immediately after marriage, before travelling.

284(i) may present problems when applying for FLR(M), if you only have less than six months left since your most recent admission. Probably safer to switch to FLR(M) immediately after marriage, before travelling.

the purpose of para 284(i) is to prevent visitors or short term students for example switching not to revent those who have recently re entered the UK on a longer term visa from switching. The paragraph poorly worded however the IDIs make it clearer see chapter 1 para 3.1
