Can I get my ILR after 5 years on different Work Perm visas?

Hi,
I was on Sponsorship Work Permit Visa for 1 year from Nov. 2007 to 2008. Then I changed to Dependent visa (dependent to my husband) till now. My husband and I , both working. At first he was dependent to me till Nov. 2008 and the he got the Tier2 visa for 3 years. And now he is in the process of getting a Tier1 visa.

1- Can I get my ILR after 5 years (from my first entering in UK at Nov 2007)?
2- Can my husband get his ILR after 5 years?

1. No.
2. He may apply for settlement as and when he becomes eligible for it (earliest in Nov 2013). You may be eligible to apply for settlement at the same time as him if you fulfil the requirements in force at the time of such application.

Tier 1 general is closed now so your husband can't switch his immigration category from tier 2.

He has already applied for Tier1 and in the process of getting it. He applied before 6th April.
