First a big thank you for the insightful contributions I have been getting from this board. I had been under the impression that we (me and my mother, I am her over 18 dependant) were covered due for ILR this September, but just found out my mum had actually made her initial application on the 12th of March 2006, and got an approval letter upon which her HSMP application was based.
Now having found out we were in fact due for ILR since September of 2010, what steps should we take and what options are open to us? Thanks for all the help and support.

Apply for settlement as usual.

In all probability, the applicants will be issued a backdated ILR. But if it isn't, I don't think you'll be able to legally challenge it ... since UKBA is not responsible for the delay (applying in 2011 when applicant(s) have been eligible since 2010).
