I am in dilema about what is correct and what is not. My solicitor said that if I take my now expired passport back from Home Office and provide them with a new one, it will n o t affect my application?

I have read somewhere on this forum that if you take back your expired passport ( wich expired during the application) and provide H O with a new one , they count it as a new application so you have to re-apply again?
I asked my lawyer and he said that this is not correct. I would only like to double-check with you. Please, I woud be grateful for any of the suggestions!

This is in the wrong forum, but in any case.

What sort of application do you have under way? When did you submit it?

Forgive me, but I must ask why is it in the wrong forum? this is European immigration and I have applied for EEA2 as a spouse of a EEA national.

I now have / collected my new passport from my embassy here in the uk and I am about to send my new passport to H O back to support my application, which I submitted on 11th of Apr 2011. I am wondering weahter i should send expired one and a new one together and is lodging my new passport to my existing application affect it? I just hope i wont be forced to re-apply for a eea2 again.

Thank you in advance. Any opinion woudl be appreciated.

There is a special forum for European Law applications in the UK: EEA-route Applications There there are lots of people who know the UK specifics of this whole thing. But it is not important.

It is no problem to get a new passport. It will not reset your application. I would NOT send the old one. There is no need and it will only possibly get lost. They do not need it.

Why did you use a lawyer for the EEA2 application? Do you have a particularly complex situation? And can I ask how much they charged you?
