Tier 1 General Reconsideration

Hi there, I have applied for a reconsideration of my Tier1 General visa on 02.02.2011 which has initially been refused due to maintenance funds not being available during 3 days out of the 90 days required. This seems to be taking a rather long time (5 months!) and UKBA said that there is no time scale for a reconsideration decision. What is the longest possible time that this might take, who could I contact further regarding this? What are the chances of being granted my visa if it has been refused based on the maintenance funds requirement? Many thanks

If you do not meet the requirements as prescribed in immigration rules, then none.

Well, infinity is a rather ambiguous answer... Did anyone apply for a reconsideration on Tier 1 General which has been refused based on maintenance funds requirement? How long did you guys have to wait and what was the outcome? Many thanks

Reconsideration is just a "request" and is not a statutory right and has no legal binding. UKBA may even ignore a reconsideration request from your end and not respond at all. Hence, the "ambiguous" response.

Ok, would it make a difference then, i.e. is UKBA obliged to reply to a reconsideration application, if it has been requested by an immigration lawyer employed by the applicant (myself). UKBA surely should at least reply, since it said on the refusal letter that I could contact the case worker if I would like to discuss my case further, which I did.
Should I contact the senior case worker dealing with my case again to get an update or would this just cause him hassle... i.e. is it better to just wait a little longer... Many thanks
