EEA2 Employee status

Post by Qman » Tue Jul 05, 2011 1:19 pm

Hi, first time poster, long time visitor. I have to commend you on all the good work you guys do here, my immigration knowledge has improved exponentially just from random visits to this site, I almost feel like a guru myself :D

I have just applied for an EEA2 as the unmarried partner of my EU girlfriend (former A8 national) and I have a job offer waiting for me but in my profession, there are some regulations about how many years a particular company must have been in business before they can take on EU staff.

The question is what will my status be if/when I receive my EEA2? (From an employment point of view, NOT nationality) Will I be classed as non-EU with full rights to work? or EU based on the relationship? That being said, I qualified in the UK and it seems the regulation is for those that came here on the basis of an EU degree.

Still, the issue might come up in some other aspect so it would still be nice to know what to call myself. Any comments (ie how stupid the post is) are welcome.

Thanks

Receiving your Residence Card means that the UKBA recognizes you as a family member of an EEA national. As such you have the same rights as the EEA national as per Article 24 (Equal Treatment) of Directive 2004/38/EC. If you are looking for a catchy word/phrase for your CV you will probably just have to go with a phrase that says that you have full working rights in the UK (the RC says 'Employment and Business Activities Allowed'). If a degree is the issue that may be more trouble.

Cheers 86ti, the degree should be no problem, it was attained in the UK so I'm golden in that respect. So as long as no one asks me for a one word definition I'll be fine :D
