two wifes one in uk and the other over tunisia

Post by aristot » Wed Jul 06, 2011 7:52 pm

hi everyone !

this my story and I am really looking for some help. 2004 got married to my ex wife in the UK lived with her till 2009 broke up for almost for 10 months . while we were apart i went to Tunisian and got married to my ex girl friend by the way I am Tunisian national with UK permanent residency .
after got married to my Tunisian wife i came back to UK and i went back to ma first wife here in UK and explain to her every thing and she didn't mind that got married to different woman . everything was all right till last year she started the procedure of divorce now I am divorced in UK and i want to bring my Tunisian wife to the UK
my question is : if UKBA checked my Tunisian marriage certificate dated on 2009 and just got divorced here in the UK in 2011, will it be a problem that could prevent my Tunisian wife from getting visa

any help will be appreciated

The marriage to your Tunisian wife won't be recognised under UK law. Therefore you'll be unable to apply for a spouse visa as she isn't legally considered to be your wife. The UKBA Entry Clearance Officer will definately check your Tunisian marriage certificate and your British divorce decree nisi absolute certificate.

Does Tunisia allow polygamous marriages? Especially if it does, have a read of this UKBA document, which is guidance to its staff.

Does that help?

Of course, they will not allow you 2 marriages!
We, Europeans, marry ONCE at the time!
They might even lodge appeal against you if they want to for your deception as you are offending the law!
Do you normally have 2 wives in your culture??
Not my concern but looks like you stayed with your ex UK wife exactly for the 5 years, more than enough to get permanent residence! Or that might be only a coincidence?

Also, you must be aware that you still dont have British citizenship, and also be aware there were some situations when Home Office did revoke not only residence cards, but also British citizenships from foreingers.

Be aware of what youare doing, and whatever you do, do it with a caution.

MY ADVICE:

Divorce your Tunisian wife , and marry her again! So it can become a legal marriage this time.

Polygamy is illegal in Tunisia. In which case your marriage to your Tunisian 'wife' is invalid there as well as in the UK. I assume you didn't declare that you were already married when you registered to marry again in Tunisia.
