Hello my fellow immigrationboard members...

I am filling out forms for a higher education grant.

They're asking for proof that I have been lawfully present in the state for 3 of the last five years.

Does time spent waiting for an asylum application to be processed count towards the 3 years?

Time spent as an asylum seeker does not count as lawful residence or count as reckonable residence for citizenship purposes.

While technically, you weren't really illegal, you were here with no permission to stay and DOJ just let you stay while your application was being processed, but it is not lawful residence.

If you are a recognised refugee or program refugee, you have the same rights as an Irish citizen so 3 years residency doesn't matter when applying for a grant. You just tick that box when applying. when it comes to citizenship, the time spent as an asylum seeker is not counted.

What is your status in the country?

I'm as legal as you can get :)

I have a stamp 4 eufam and prior to that I was an asylum seeker.

I went along to the county council today and they consider lawful presence in the same way as you suggested, meaning that as long as you were documented you were lawfully present.

Monife: There is a remarkable difference between lawfully present and reckonable residency. Asylum seekers and even deportees are legal in the country. The law allows them to be present here albeit on a temporary basis. They definitely have a right to reside and move freely even though they are restricted in terms of employment.

They can even get married, like I did. ;)
