URGENT - Please help - Tier 1 PSW to Tier 2 General

Hi,

I've been working with my current employer for more than 6 months while on a Tier 1 PSW visa and my employer has agreed to provide a certificate of sponsorship for me to apply for a Tier 2 General visa. I met all the criteria for Tier 2 but my only concern is I am a temporary member of staff.

I can't find any info on the UK Border Agency website. It just says that you need to have worked for the employer continuously for 6 months prior to the application and that you intend to be in the same job. Which is true in my case. But I am worried that my application could be rejected because I am not a permanent member of staff.

My employer is of course aware of this and happy to support my application despite I am a temp. Do you know if you need to be a permanent member of staff to be successful with the application?

Do you already know the length of your employment contract? If so, what is it?

It is a rolling contract.. The employer is happy to act as my sponsor and although I am a temp, they intend to keep me as long as possible.

your contract must say that you are at least working 30 hours a week to satisfy tier 2 criteria!

Thanks Arsenal49. I am covering a full time post, i.e, 37.5 hours per week. My only concern is could the UK Border Agency reject my application because I am a temp employee? Work has agreed to sponsor me and I meet all the criteria (I've been with the company for more than 6 months, salary ok and english language requirements ok).

your employer's classification of 'temp' and 'permanent' employee has no bearing on tier 2 app.

if you are working 37.5 hrs and employer has given you a contract for x number of years beyond psw... then you satisfy the visa requirement.
