Query...strange case....need your suggestion

Post by wasim_n » Thu Jul 14, 2011 1:16 pm

I applied for Tier - 1 General visa in August 2008 from Dubai along with my dependants, received my documents back in November 2008 with a refusal letter stating my educational documents were not attested with the relevant bodies and they gave me a right of appeal. I lodged an appeal against the ECO allegation in the same month (Nov-2008) stating all my documents were duly attested and the ECO has overlooked.

Never got a reply till October 2009......

In October I received an email from ECM stating my case has been transferred to Abu Dhabi BHC as Dubai office being closed, and as it was their mistake for giving me a right of appeal they want me to fill in the Admin Review form and they will accept it lately, which I eventually did.

In January 2010 ECO decision was overturned and I received a calling letter from Abu Dhabi BHC asking to submit our passports for visa stamping at that time I had moved to Pakistan permanently due to severe health condition of my dad. I requested to submit my passports in Karachi VAC, and they accepted.

I submitted all our passports at Karachi VAC with calling letter and in April 2010 got our passports with visa stamped valid till April 2013.

I traveled to UK (alone) in May 2010 to cover the period of 28 days for ILR, but in June 2010 had to go back to Pakistan for a personal reason plus could not get a job. In November 2010 moved back to UK with my family and fortunately got a good job in a reputed firm as Finance Manager and am here now.

My queries :

1) When I apply for extension in April 2013 what date must i mention on the form as first application submit date ?

2) Do I need to submit any additional documents at the time of extension as my case being bit strange or it would be all standard docs i.e. salary slips (UK standard) + bank statement + Passports + etc... ?

3) At the time of my first application I was 28 years old (obtained 20 Points) and at the time of extension I will be 32 years, how many points can I claim at that time ?

4) I was away from UK from 21st June 2010 - 4th Nov 2010, will I need another extension prior to ILR or I will be covered

Any other important suggestions/recommendations would be appreciated.

Thanks......... this is a great forum

Standard documents should be fine

20 points - you get the same as at your first application

Yes, you only permanently moved to the UK in November 2010 - when you entered in May, you did not permanently settle here (which you could have got away with if you left for less than 90 days and then returned again. Your ILR clock started Nov 2010, not May 2010.

Since you have broken your link with the UK during the period your period would start from November when you came here on permanent basis, and therefore you would need a second extension. Good Luck
