Hi all ILR experts

I came here in UK about 2 years ago on spouse visa and have been living together in a council flat with my wife. Now I would like to apply for the ILR but I would need some help in understanding some public funds questions in the form.

My wife is claiming Housing benefit and Council tax benefit and including my name when claims this because this aren't claimable single. So I've a couple of questions

1) Do these fall under public funds and if so, does this affect my application for ILR since the application guideline for ILR asks not to claim public funds by me or my partner?

2) What will be the answer for the question 7.6 in the application form in my case? I'll really appreciate your kind help. Thanks in advance.

Your visa should say' no recourse to public funds' hence you cannot claim any benefits. If you do, you will be refused ILR on those grounds.

Thanks for your reply but I'm not claiming benefits but my wife is. Is your answer based on any personal or legal experience? There are a few old posts that I've seen here where experts said wife claiming benefits doesn't have an effect on husband's ILR because as a UK citizen wife is entitled to some type of benefits. Anybody else can help please?

Yes she is working and earning 90 pound a week. I'm also working and earning 50 pound a week.
