will overstay affect getting EEA family permit for non-EU

Hi, I am a non-EU citizen going to marry EU citizen - Cypriot (who has been in UK for many years but never applied for Residence Permit or anything like that) in my native country (Russia). I overstayed in UK for 3.5 years (have been living all this time with my future husband). Would that affect me getting EU Family Permit and come back to UK with him? What period of time does he have to show his bank statements, pay slips, etc. for?

What visa status did your Cypriot partner have in the United Kingdom before 1 May 2004? (when Cyprus joined the EU)

He is also an UK citizen. But we were told that procedure of applying for visa for me as a wife of EU citizen is easier. How does his status before 05/04 can affect?

Be careful about believing things you are "told". It is easier to sponsor for an EEA Family Permit compared to a spouse visa. And the cost of the EEA Family Permit is zero.

BUT - do you realise that with a spouse visa it will take you two years to get permanent residence in the United Kingdom. While if you get an EEA Family Permit, it's five years.

And that you cannot apply for British citizenship by naturalisation until you have permanent residence (with three years legal residence, as you're married to a British citizen).

Think about your options.

I know that but as long as I can be and work in UK legally with my one and only I am happy. I am not in a hurry to get PR. Do you think I have good chances of getting a FP? What is the best way?
