Work permit query

Post by jcoreillyuk » Mon Jul 18, 2011 3:48 pm

In 2008 we recruited someone from Canada. We got a work permit for him for his specific role. Last year he was promoted. The new job is on a higher salary, has a different title and job description but within the same organisation. I am aware that a work permit is for a spcecific role and think that the changes amount to more than a technical change - but perhaps not?
An oversight at the time (which we have just discovered) meant that we did not get a new work permit (tier 2) for him for this new role.

What should we do now?
We do not want to risk our A status as a Sponsoring employer.

If I were you I'd wait for the next payrise and then apply ukba saying "he's been promoted and his salary is increased 2%-5% whatever...what do we need to do?"

I'm not a solicitor or an expert but I remember reading in this forum comments like: 'additional information and unnecessary honesty is NOT GOOD'... as their attitude and the policy changed from 'goodwill' to 'will-to-get-rid-of' imo.

If his pay has not gone down, then the question is whether the new job is within the same SOC code as the old one? Was either his old job or the new one a shortage occupation?
