Legacy Pre protocol action JR and evidences for Court

I am on legacy and my case was refused. I put in a pre action protocol letter but now I have new supporting evidence as i have got a 10 days old child. I am not living with the mother but my name is on the birth certificate and the mother has an ILR, I have sent the birth certificate and a letter from the mother to UKBA today showing my regular visit to the child. Will they consider this new evidence in court although I submited it after the decision was made? What should i do in this case. Please help.

I sent a reconsideration letter and after few weeks i sent a pre protocol letter. Two weeks after the pre protocol letter, UKBA reply to my reconsideration saying they are returning my documents and I need to book an appointment to submit them in liverpool as they do not accept further submision by post. The question is that, i asked for reconsideration and they returned my documents for me to do further submision in liverpool. Can someone explain to me please why they said for me to go to liverpool? Your help is needed. Do I have a chance as it is seldom for UKBA to advise people to do further submision. Thank you
