Bringing my fiancee to join me.

Post by pocketpc » Thu Jul 21, 2011 2:38 pm

I have recently just acquired UK refugee status, I am a citizen of UGANDA who has been living in Malawi but left for the UK, and have fiancee a Malawian , who i mentioned during my claim, before the status was granted here in the UK.. On what legal basis can i get my fiancee to join me in the UK? Even in the event that we get married in the 3rd country(Malawi) in a few months.
advise would be appreciated.

The requirements of the Immigration Rules relating to new spouses of persons already granted refugee status are shown here:-

I can't see any provision for fiancees of people in your position, so it would appear your only recourse is to marry her.

Effectively, your wife will have to pass an English test and you should be able to provide adequate support and accommodation for her in the UK.

Hope you/she have the 810 quid visa application fee....

had you been living together in a relationship akin to marriage before you left Malawi to claim asylum in the UK?

if so you may not need to go down the route suggested by Mr Rusty

Difficult, if not.

that case is about post flight spouses. I am asking the OP whether he lived with his fiance in a relationship akin to marriage for two years before coming to the UK. If so she may qualify for family reunion under paragraph 3190

Had been in Malawi for less than 2yrs, which gives a NO! to the answer of living together for 2 yrs. However i am ready to marry her soon. In the case of proving that i can "accomodate and maintain" her, what documents do they need me to submit? I am also guessing there is no time limit, as to when i can invite her or apply for that visa? For as long as my 5yrs and stay are still valid, am i right? 810 pounds for the visa is quiet hefty, but one will sacrifice any amount to be joined with their loved one i presume.
