EEA application and pasport lost by ukba

Hi there,
I applied for EEA2 on 2nd of june 2011.
Then i request back my passport and my wife's ID card on 28th of June.
And today received a letter from UkBA that they could not trace my passport and my wife's id card.
So which means they lost that which is very unlikely that they lost only id card and passport.
They attatched two letters that you can take to embassy and get new documents.but problem is my wife's passport is expired,she had only id card which according to them they lost.and her (eea national) embassy dont make id card or computerised passport. They issue only temporary passport here.which is no good for us and it means she has to go back home.and apply new id card. But ukba say they can only compensate the amount incurred to get ids only in uk.so what should i do now.

If the letter is generic, it would be nice to see exactly what they said they would reimburse.

What country is your wife from? They only issue temporary passports in London, even for long term residents of the UK?

I would keep ALL receipts and I would bill UKBA for the total of all your expenses to replace both your passport and her ID card. Ignore what they say on the letter, and give them the full bill. You can also go to small claims court and I suspect you will win (or more likely they will settle for the full amount).

Thank you for your recent request for the retufn of your Passport your sponsors Identity
Card, which had been submitted to the Home Office, UK Botder Agency, in support of an
application for a vadation of leave to remain in the UnitedKingdom'

Regrettably, despite an extensive search having been undertaken, we have been unable to
locate your Passport and the Identity Card within out Agency. Any claim for compensation
that you may wish to make to the Home Office fot this loss must be made in writing,
enclosing relevant expense receipts etc., to the address given on the attached page. Only
additional costs incurred within the United Kingdom will be consideted.

If you require a Passport and Identity Card immediately, you should now approach the
Embassy in the United Kingdom. This letter and the enclosed ICD.3607 letters should be
presented to them in order to obtain a replacement document. In the event that you obtain
a new Passport or Identity Card, you should inform this office immediately.

The team currently considedng your application is aware of the difficulties experienced in
this case. They will, where necessary, contact you directly to request any additional or
replacement documentation that may be required before the application can be completed.

My wife is from Hungary and Hungarian embassy clearly says that they cant make ID cards or Biomatric passports here in uk.so which means we have to go to Hungary to get ID of my wife.
How can we make them pay for expenses incurred outside of UK.
As they clearly say in letter that they can pay expenses only spent in uk with valid receipts.

Well you can not "make" them do stuff. But you can explain that it is impossible to get a replacement in the UK and submit the bill. If they refuse to pay you, then you can take them to small claims court. The judge can "make" them pay, or might not.

You will need to have proof that it is impossible to apply for a Hungarian ID card or normal passport in the UK. Is it on their web site? Or get them to send you a letter....

Yes you got it right,they have seen all our documents.we requested back our passport and id and they lost it.they should not request it but anything is possible with them.
Also any idea that within how long i can claim my expenses after receiving letter from them.Coz what i m planning is that we both will go together to hungary once they processed my RC card to get my wife's id and put all travel and every claim for both of us together to ukba. )
