hai everyone,

i have two questions regarding the ILR. hope somebody will clarify my doubts.

1. my wife, a nurse, arrived uk in Oct 04 as a student nurse. after adaptation, she got workpermit in sep 05. which year will be taken as her entry date for ILR?

2. she went on Maternity leave by end of march 2006 to her native country and returns only by 20th October 2006. say 7 months leave including mat leave and annual leave. will this be a problem? how long can someone be away for continuously in these 5 years qualification period? if she comes for one week now or some time in august, will this help the matter?

It will start from first WP entry date. If you can explain the absense, it should be fine.

Hi Thomas,

Ur saying that ur wife got work permit in Sept. 05. Then how she came here as a Student Nurse. She must be having work permit on which she came as a Student Nurse. Otherwise she won't be able to complete her adapatation. Becoz my wife came to Uk as a Student Nurse on work permit in Sept. 04. Then she completed her adaptation and after that she applied for Further Leave to Remain as her entry clearance visa was till July 05. After getting Further Leave to Remain till May 10 she got new work permit valid until May 10. I feel that home office will consider Oct 04 as her entry date for ILR.

But I am not aware about the second point, whether her long absence will be considered or not.

thanks for the info.

she was given a student nurse visa in Oct 2004 for one year. that is how she came here.

long absence is the doubt troubling me day and night. somebody help me...please. or give me any clue where to get the info, website or any doc
