Tier 1 Gen. Migrant, but never entered UK- EXTENSION

Post by dil2040 » Wed Jul 27, 2011 12:13 am

Hello,

I hold a Tier 1 General Migrant visa but never entered UK since it was granted in 2008. Now, i stay in the US and wish to know if i can extend the HSMP for a second term from here.

If Yes, what are the procedures, timelines and eligibility reqts.

My tier 1 is valid till Dec 2011.

thanks

Dilip

No, you cannot extend from outside the UK.

You can travel to UK and apply for extension from inside UK with your US income.

It may not be that straight-forward. Firstly, the OP isn't using the visa for it's intended use and may be denied entry into the UK.

Secondly, I think the OP will find it very difficult to arrange an extension while not in the UK. E.g. what postal address to use, how long to wait around in-country etc. It is simply not a straight-forward process where you can arrive in the UK, stay overnight in a hotel, go and get your visa and go back.

Thanks !

However with some googl-ing i see there are Tier 1 Postal service and Premium service. Is that Postal service not applicable if i send documents from the US and give a UK address (friend or relative) for Home Office to respond. Will that not work ?

Thanks again for your interest in helping thru your responses. !

You can not deceive home office like this. They can easily check from your passport where you are.. and ban you forever..

Then there is the problem of how to give biometrics in person.........

Plus there will be no entry stamp.........

Plus you have to give all your addresses over the past two years

In addition, you need to state when you entered the UK.....

You would also have to sing the declaration......

What's the point of trying to hold onto a Tier 1 visa when you are not using it. It seems unlikely that you will ever be in a position to claim ILR from it (if they apply the limit of 5 years leave for Tier 1 visas, or even worse, eventually do away with extensions - which they would have to do at some point).

It all just seems like it's not very well thought through...
