Applying from PSW to Tier 2 General WITHOUT COS

Hi,

I will be sending my application very shortly and I have all the required docs for applying for a Tier 2 General Visa from PSW. My A-rated sponsor has agreed to apply for CoS but there have been some delays due to some issues re log in to SMS. My employer has been trying to get a response from the Home Office for the last 6 weeks without any success!

As my visa is expiring next week and I don't think my employer will be able to get access to SMS in time to apply for my CoS, I was thinking of sending my application with a letter from my sponsor, which explains that the CoS will be processed shortly and that the delays are due to the lack of response from the Licensing team at the Home Office.

How are my chances of the application getting approved or rejected? I am hoping that they would be contacting my employer or myself to find out more before, instead of just rejecting my application?

I am very anxious as my visa is due to expire v.soon and I won't be able to wait any longer for the CoS!

I really need to know my chances for applying for a Tier 2 General visa from PSW, with a letter confirming that CoS is in process and that explaining that the delays were due to problems accessing the SMS.

if you don't have a COS , you dont have a COS

no reason is big enough for caseworker to NOT reject your application incase you dont provide them with a cos!

i suggest you try some more and get it before visa expires. it only takes 5 min to get one assigned! so keep trying

I don't think I'll be able to obtain CoS before applying. My employer has confirmed today that they have just posted some paperwork to UKBA to be able to log in to SMS and I don't think they will get a response for next week.

Visa is up next Wednesday. I don't seem to have any other solution..

I think you should go ahead and apply and provide all the supporting paperwork. They might consider it and send it back or call for obtaining the CoS once you get it. Unfortunately, thats the only option you have and its a lot better than overstaying illegally even if its for a day. Provide solid paperwork by your company providing the details of why it was delayed (also they might want to know why you left it so late to apply?) Just my own opinion.

Best of luck and hopefully it would be resolved.

I concur with silverchloride on this one. IMHO, you will be worse off if you don't submit a new Tier 2 application before the expiration of your Tier 1 PSW visa.

Ideally, you are required to have a CoS before you can submit a Tier 2 application, but the fact is that you don't have one yet. I'll give it up until a day or 2 before the expiration of your current visa. If you haven't got your CoS by then, I'll send my application without the CoS but with a cover letter explaining your situation.

In any case, continue chasing the UKBA on your CoS - even after you have submitted your application. If it eventually comes through, you should send it right away. Try to delay any chance of a decision being made on your application. This will buy you sometime to sort out your CoS.

I will send application and cover letter by post the day before visa expiry date. Hopefully, I should get CoS reference before they make a decision on my application.
