Hi. Can you help me. I try to apply eea1 application, and i have a few question. My wife is applicant, She have a Latvian citizen. Is she need to fill section 3, and need tick the box in section 1, I think what she not needed fill section 3 and tick the box, how you think? Thanks

Are you sure you got the right form?
Is this for yourself (non EU) and your wife is the sponsor or for you wife (EU) only?

Yes, I'm sure. I have a aliens passport of Latvia (Non EU), My wife have a latvian citizen, Now i apply for residence card(EEA2), But need have a eea1 (registration certificate) as well for my wife. And now i apply EEA2 form, my wife -EEA1, and i want will send a both application.

Please tick this box only if you are applying as the family member of an EEA national who is exercising Treaty rights in the UK but who is not applying for a registration certificate at this time. Please complete section 1 and 2 with your details and those of any family members also applying on this form. Section 3 and 5 should be completed with details of your EEA national family member who is exercising Treaty rights in the UK.

SECTION 3 – YOUR EEA NATIONAL FAMILY MEMBER WHO IS EXERCISING TREATY RIGHTS
Please give the personal details of your EEA national family member who is exercising Treaty rights in the UK. You must only complete this section if they have chosen not to apply for a registration certificate at this time.
Note 1. There is no requirement for your EEA national family member who is exercising Treaty rights in the UK to apply for a registration certificate and we can decide your case without them applying. However, we must receive evidence of their identity, e.g. passport or identity card. If your EEA national family member wishes to apply for a registration certificate, their details must be entered in section 1 and your details in section 2

And when i was call to border agency , they told me, what will be better if i will send my work contact and my bank statement. How you think which document need to send him ? Many thanks

Now it is clear.
First of all, your wife doesn't NEED TO HAVE Residence Certificate (EEA1). She can work and live in the UK without it. You also don't need Residence Card but for non-EU is advisable to apply for (to show to employers etc).

If your wife wishes to apply for EEA1, then as you said apply together (same envelope) for both of you (EEA1 + EEA2).

Your wife should not tick the first box in the application.
She should complete section 1.
Not complete section 2, 3, 4 (you were right).

then depending on how your wife is exercising treaty rights section 5 or 6 or 7 or 8.
Complete section 9,10,11,12

How is your wife exercising treaty rights? Is she working or is it only you who work?
Section 11 explains clearly which documents you need to provide depending on your case.

Thanks. I and my wife working more than 1 years. Which documents need send with application ? And i have a son, he is latvian citizen too. Can i apply section 2 for my son? But he is 1.7 years old. Thanks

Did you read section 11 of the form? All documents needed are listed there.

Basically it's your passport, your wife passport, proof of your wife employment (recent payslips or a letter from employer), proof of relationship (marriage certificate for you, birth certificate for your son), proof of residence for both of you (council tax bill or utility bill).
Your employment is not relevant. It's the EU national employment that is required.

You can apply for your son also. Use section 2 in EEA1 for him. You will need to provide his passport + birth certificate.

You need to provide proof that your wife is working (exercising treaty rights as a worker), for example by sending in some payslips or a letter from her employer.

That you (as non-EU family member) are also working is nice but not relevant for the EEA1 and EEA2 applications and you do not need to send any documents referring to your job.

Children who have EU nationality (like your son) can be included on the EEA1 form for your wife; children without EU nationality (which you apparently don't have) can be included on the EEA2 form.
