PSW to TIER 2 as a Contractor

Hi all

I am on a PSW visa and have been working for a company for just about 2 years now through an agency (as a contractor). My company wants to make me permanent.

My question is, would my company still have to do a RLMT in this situation?

Or can it be argued that because I have been working in the company in the same position, a RLMT is not required??

Any advise is appreciated!

You are not employed by them so they have to do the RLMT.
