Tier 2 ICT Short term staff to Long term staff

Hi,

I had applied for Tier 2 ICT Visa through my employer and they have considered my application as a Short Term Staff Category since the Salary they are offering is less than 40k GBP. Since its a Short Term Staff Category, i will get the Visa for duration of 1 year only.
And i quote the details of the Short term staff : "The Short Term sub-category allows existing employees to transfer to the UK for a maximum period of 12 months. The position you will come to fill in must be at graduate level or above with a minimum salary of £24,000 per annum. Following completion of a period of leave under the Short Term Staff subcategory you will not be able to apply for leave under any ICT sub-category (apart from the Long Term Staff category) for a period of 12 calendar months from the expiry of your previous leave."

If in the 1 year of me working in UK on Short term staff ICT, if my salary gets increased to more than 40K GBP from my current. Will i be eligible to convert my Short Term Staff Category status into Long Term Staff Category Status being in UK itself.

If I have to come back to India and reapply, is there a minimum period limit after which only i can reapply under ICT Long Term staff or i can reapply immediately i come back to India and get it processed?
