Help with OCI card for my daughter

Post by rajaryan7678 » Sun Aug 14, 2011 8:38 pm

Hello,

My name is Raj Aryan. I am staying in UK since 2004. I received Permanent Residency visa in 2009. My baby girl was born on March 2011. I would like to ask few queries about her OCI card. I am aware that she is eligible for British Citizenship. I am also aware that she is eligible for OCI card if either of the parents is eligible for OCI card.

As we had to visit India, we got her Indian Passport but the trip is now cancelled and we didn't visit India. Now she has her Indian Passport without any visa. Can you please let me know the correct process of getting OCI after getting British Citizenship from the following options:
Apply for her British Passport. Then apply for her OCI by submitting my Surrender Certificate (for Indian Passport) & surrender her Indian Passport (without any visa stamped on it) OR as she has her Indian Passport, apply for Permanent Residency Visa first and then apply for British Passport and then for the OCI card.

Please let me know the correct process as I want to take her OCI.

Many thanks for your help.

Thanks and Regards,
Raj Aryan

Have no idea on the Indian side of things but if your child was born in the UK your child is not eligible for British citizenship, she is already a British citizen from birth. A passport is just a travel document. Having or not having a British passport doesn't change the fact that she is already British. No need to apply for a visa for her. Just pick up a passport application form from the Post Office and apply for a British passport (takes about 3 weeks).
