HSMP Extension - Driving offence

HSMP Extension - Driving offence

My HSMP extension is due in March 2012 and I have got a motoring offence.

I was given a Fixed Penalty Notice by Police officer for driving without insurance. Although I had fully comprehensive insurance and I was driving my friend's car, and he was with me at time of offence. I was driving his car with point of view that I had fully comprehensive insurance so I could drive others car as third party cover.

Later on I checked with my insurance provider and they told that I was not covered to drive any other car.

I challenged this thing in court that I had fully comprehensive insurance and had no intention to drive without insurance.

Unfortunately on hearing date I was in hospital and couldn't attend court, court went harsh and increased my fine and points.

I requested court to reopen case but they refused and gave right to appeal in crown court.

Its a big mess to go in crown court so I have decided to give up and pay the fines etc..

Please advise in which was is it going to effect my hsmp extension?

No effect on the extension but you'll have to wait for a court fine to be spent before you can apply for ILR. Hindsight is a wonderful thing but it would have been better to accept the fixed penalty as that would not be considered.

Is it the same rule for all type of offences i.e. unspent offence doesn't effect hsmp extension?
Does it mean that unspent offence can be ignored for HSMP extension, e.g. CCJ, false representation etc

If you are covered by the HSMP JR then this will not matter for you. The old rules will continue to apply.

Please can you expand on what the false representation is about. People can only give limited advice is you give a limited view of the facts.

I think I am not covered by HSMP JR because I was first issued HSMP in March 2009. Am I covered under HSMP JR?

False representation is Convicted in crown court for "Making False Insurance Claims" and using "False ID", and as a penalty a Community service of 300 Hrs.
In other words false representation is another name of fraud.
