Applying out of country – where from?

I’m an Australian Tier 5 (YMS) visa holder whose my employer has completed a resident labour market test and is applying for a restricted COS for an out-of country application.

I understand that I need to apply for entry clearance from a country where I have more than 6 months leave to remain. My question is, do you need to be in the country for a certain period of time first? Because I am Australian & under 30, I can apply for a number of different European working holiday visas. I am wondering if I can avoid returning to Australia by applying for a German working holiday visa, which gives me 12 months leave to remain in Germany, and then applying for entry clearance from Frankfurt.

Thanks, but that confuses me more...

Apparently I have to apply from my country of residence – which is the UK, as I have a valid Tier 5 visa through to May next year – but you can’t apply from within the UK. Does anyone else have any advice?

'Country of residence' is not necessarily their country of origin and refers to wherever the applicant has permission to reside, e.g. for work or study purposes. Many countries will issue overseas nationals with residency cards in these cases. An applicant who has permission to stay in a country as a visitor for 6 months, for example, is not a resident.

well... in that case UK is out of question.... which is the next country that satisfies the criteria , on your list?
