Discretionary Leave, pls help

Post by magic7 » Tue Aug 30, 2011 6:24 am

I first visited the UK twice with a 6months visa, i then renewed it from bk home and was issued with a 2 yrs visa. I met my wife the second time I came here when i still had the 6 months before and we remained friends. She came over to my country and we got married in a registry and both came bk here for honeymoon when we found out she was pregnant. She had a really bad pregnancy which made her to quit her Uni. I wasnt able to go bk as she was too sick to take care of her son(stepson for me). I have overstayed my 180days period on my 2 yrs. Would they have any reasons to deny me a DL because we have a new born daughter now and our son calls me dad, and its going to affect all of us in everyways possible?

Summary
6 months visit visa - first visit 30 of march 2008
second visit 18 of june 2008 and met wife. spoke online and phone calls since then until 2010
Renewed 2 yrs visa in 2010 - visited wife in july 2010 for 2 weeks.
wife visited me in Ghana October, we got
married in registry and came to britain together for honeymoon. Wife pregnant and gave birth. My actual visa dont expire until 2012.

Be patient. You posted at 6 am and then again 3 hours later.

If you need urgent advice go to see a competent immigration solicitor or advisor.

Sorry bout not being patient, I did have an appt with a lawyer that afternoon and i was just weighing my case to find out if its possible or just to go back home to apply for spouse. The problem is, my daughter is very sick from birth and myself and my wife been in and out of hospital since she was born. Leaving her alone to deal with this isnt an option plus her post birth depression. We also have a son and with school starting next week, she wont cope alone. pls any advice on the outcome would be great. Thank you all

So today I got a letter from UKBA dated on 02/09/11 with my reference number on it saying my application has been passed to a caseworker. And they also wrote I should not call to find out the progress of my case. well does anyone knows when I should expect to hear from them again? 3-5weeks? Hopefully it will be positive.
