Switching from Tier1 dependent to independent visa

Post by blueyonder » Sun Sep 04, 2011 12:24 pm

I am currently a dependent of a Tier1 visa holder. Are there any visa categories where I could qualify to have my own visa? Which are they?

Any assistance on this would be much appreciated. Many thanks.

Which immigration categories you may qualify for will depend on your preferences (e.g. - wish to study, wish to work, with neither but only live in UK) and whether you fulfil the eligibility requirements, so no one can put them on the table for you. Have a look at the UKBA website for the various immigration categories available, and which ones you may qualify for depending on your circumstances.

This said, as a PBS dependant you cannot switch categories from within the UK. You'll need to apply from outside UK.
Life isn't fair, but you can be!

You can't actually switch into any of the PBS categories from inside the UK. Which of those categories might suit you depends on your wealth, skill set, qualifications etc so you'll just have to look at the requirements for each; we can't begin to guess your circumstance and make suggestions. This assumes that you are already in a relationship with a PBS migrant and therefore can't investigate a settlement category based on spouse/partner.

Thanks for your replies.

Just to clarify - I am currently the spouse of a Tier1 visa holder. I am currently working and wish to apply for the Tier1(general) visa or any other visa which gives me an independent status. I don't think there is any other Visa category other than the Tier2.

Could you clarify for me whether dependents can still avail of Tier1 visas even if it means leaving the country?

No, you cannot get Tier 1 General.
