At the end of visa - need to return to home country?

Post by nafe12 » Mon Sep 05, 2011 1:00 pm

A friend of mine (yes, actually! :) today told me she has a warning stamp on her passport.

She had leave to be here as a nurse, on the last day of her visa she went to visit morocco for a few days. When she came returned to the UK - she wanted to enter as a tourist/visitor. (She had finished work, had no intention to work, had flights booked to Croatia in a few days). She showed this (flights), bank accounts, etc etc to the immigration officer who didn't say anything but put a warning stamp.

The next time she went through immigration, they almost deported her because she was classed as an overstayer because she did not go back to her home country.

She thought leaving the UK before her visa ended, and returning as a visitor was fine (no longer working, just a tourist); but the immigration officers said that she has to go to her home country (Australia) first.

Is this correct? I looked through the immigration rules, and can only see rules about leaving the UK/Common area, not a need to return home?

Any hints? Thanks

They assume she would go to her home country but she is entitled to go anywhere she has a visa for (or doesn't need a visa to enter).

It just looks a bit suspicious if someone tries to enter as a visitor a few days after their work visa ends.

If she has some kind of bad UK stamp in her passport perhaps the officer was suggesting she would need entry clearance in order to come back. If she was going to get entry clearance (a UK visa) she would have to return to her home country to apply for that.

Agreed. That's why she brought her itinerary to show she wasn't staying.

Interestingly, they let her in the second time, but took down her whole european itinerary in detail and said if she deviates from that (which includes a few UK trips) then she will be banned for 5 years or something.

This is how she explained to me, but it doesn't quite add up to me..
