hi,

I need some expert advise on some of my questions,

My name is Rati, i am currently working in Delhi,India. Last month my husband moved to UK on a long term assignment. So he is currently on work permit. My husband is insisting me to go along with him for 1 year. Since I am working in India I donot want to leave my job and move to UK for 1 year.

my question is
can I working from home(which is UK home) and draw Indian salary? is this permissible?

Does companies allow this of options?

Well it's permitted for you to do this in the UK but it's not clear if your question is referring to whether the Indian company will permit you to do this.

If you are resident for tax in the UK you will may to pay this to HMRC (unless there is a tax treaty with India).

You mean "can the salary be credited in India (as usual) when you work from home in UK"? Then, yes - as long as your employer is okay with letting you work from home in the UK, and complies with UK laws regarding any tax liabilities (if any) because of you working out of UK.

This said, you may also need to provide a letter from your employer certifying that you are being allowed to work from home (in UK) and you will remain employed with your employer for your duration of stay in the UK.

my company doesn't have policy like this(i.e work from home(UK)), so i donot have offical letter or any other form allowing me to work.

but my company allows working home(i.e Indian home). So without letting others know about my residence status I am planning to work.

Is this legally correct? i.e my company will not be knowing from where i will be working, my company will assume that i am India only.

I'm not sure why the UK would need an official letter giving you permission from your employer to work in the UK and saying she will remain employed for the duration; can you elaborate? For the OP, it makes sense to tell your employer that you are in fact in India rather than them assuming you are in India. Why would you do otherwise?

You may not be issued a visa if you do not provide a letter from your employer to state either that you'll be on authorised leave or allowed to work from UK - for the duration of your stay in the UK.

Else, you'll be need to resign from your job and state "resigned / unemployed / not working" as your employment status in the application.

Lying is not a route one should take when making an immigration application. Lying to an employer may cost you your job - which you seem not willing to let go off.

Is there a link to that information? My understanding is that provided they are not a doctor in training and comply with UK tax laws, there is no impediment to a Tier 2 dependant's scope to work in the UK and no other conditions attached to a visa application in that category.
