ILR - 28 days before eligibility date calculation & Earn

Post by ilr_hsmp2007 » Wed Sep 07, 2011 8:35 pm

Hi All,

I am due to apply for ILR in jul-2012,

I came to UK on 04-AUG-2007, But my actual entry clearance date was stamped on 01-AUG-2007 ( I entered U.K 4 days after the EC)

So,what is the earliest date I can apply for based on the 28 days before the eligibility for ILR

Do I need to take 28 before from 01-AUG-2012 or 04-AUG-2012.
--

ILR Salary requirement -
I am getting the 45 points for this year from APR-2011 - OCT-2011 , does this period is enough to show the ILR in JUL-2012?

Does this period falls 12 months period within the 15 months before the elgibility date of my ILR?

I am not planning to claim the whole 12 months, Does this enough to meet the ILR criteria?

thanks

Hi sushdmehta,

thanks for the info.

So I need to take 28 before 04-AUG-2012. (not on the 01-AUG as my first visa stamped)

Did you read through information in the link provided above (or the guidances, links for which have been provided the linked topic)?

The questions suggest that you haven't!

Hi sushdmehta,

I think answer under FAQ # 1 in the above link is not correct.

Reason is: For a person who gets his EC stamped out of UK and enters UK with in 3 months (i.e., 90 days) from that date, then his 5 years qualifying period for ILR clock starts from the date his EC visa was stamped, if s/he enters after 3 months from the EC stamped date, then yes ILR Clock starts from the date they entered UK.

So I believe answer in FAQ # 1 in the above should be amended to add third criteria as mentioned by me above.

Please correct me if I am wrong.

Hi ,

FAQ is correct, the date we enter into U.K is considered for ILR , not on the visa stamp.

where did u find that info? Can you point, its good to know and everyone looking for this kind of details.

thanks
