ILR Application while receiving Child Benefit.

Post by elric » Wed Sep 14, 2011 11:06 am

My wife is about to apply for her ILR as she has been living in the UK for 2 years on a spouse
visa. About 10 months ago, we had a child who was born in the UK and is a British Citizen.
I am a British Citizen. After our child was born, my wife applied for the Child Benefit and
it is in her name and is paid into a joint bank account. When she made the application, she marked
that she was under immigration control. We operated under the assumption that the request would
be denied if she was not supposed to be receiving the child benefit. But, now, on the SET(M), it
asks if she is receiving the Child Benefit and this prompted me to do further research on the topic
and I can't quite determine from reading online documentation at UKBA and searching whether
this will be an issue for her ILR application. So, is this going to be a problem?

You should have made the claim for child benefit in your name...not your wife.

Yes, in hindsight, I should have either applied myself or simply not bothered. But this is unfortunately
not the case. So, given that we are in this situation, will this cause my wife's ILR to be refused? And if so,
what steps can we take to rectify the situation?
